Asa, regarding this pest control poisoning story, I found an interesting attorney's web site at http://tinyurl.com/LaytonPoisoning
There I was surprised to learn that:
- Investigators did say they recovered over 1.5 pounds of the substance, or around 800 tablets.
- In the manufacturer's manual for this poison, it states in bold letters "This product must not be applied into a burrow system that is within 15 feet of a building that is, or may be occupied by humans, and/or animals, especially residences.”
- Testing shows that the toxin was applied 3 feet from a garage door and 7 feet from the front door.
- Deviance from the manufacturer’s instructions on how to apply this dangerous poison is basically failure to follow the applicable standard of care, and in a legal context, is considered evidence of negligence.
- The pest control company, its employees, and even the poison manufacturer are subject to civil and criminal penalties. The family has the final say if there will be a civil lawsuit. The local district attorney has the final say if there will be a criminal trial.
My research has revealed that for the state of Utah, a wrongful death civil action has a statute of limitations of two years and a negligent homicide criminal action has a statute of limitations of 4 years. So both the family and state have some time to make their decisions. And while it is true that some sources are reporting that the family is not thinking of any legal action now, I suspect that because of the notoriety of this case, lawyers will try to contact and influence the family. Any cash judgment could be split with 60% going to the family and 40% going to the lawyers.

The rest of us had chicken. I also made my famous chocolate cobbler and wow, it was some kinda good. So, we are stuffed and content, enjoying the fire on this cold, rainy night. I just tucked Erin into bed after reading to her. We just started the Little House series and are reading "Little House in the Big Woods". Yes, MDC, it's a large capacity front loader and I love it. So easy to use and uses less water than the top loader, which is good since we have that aerobic septic system. I know exactly what you mean about doing laundry outside in the summer...been doing that for years and it is no fun.

I think Boo gave it to me. Boo, how is Bruce doing?
Well PH and Auh2o, I'm a spring guy all the way. I love summer as well. I could love Fall the best if I wasn't so bummed out knowing Winter follows it. Anyway, it's all good I reckon.
Well Bill Clinton was rushed to the hospital yesterday, had emergency surgery to install two stints, and has been released this morning and expected to be back to work on Monday morning. Sounds like a broken health care system to me. I do wish him a full recovery, and hope that being a recipient of such wonderful health care might quit the attacks on our current system. Although not perfect, it's pretty darn fine and light years ahead of other systems (from everything I have read)
That's awesome about your drummer friend Rev. Hope his face don't break out moving to the top like that though. :)
Once again, thanks for all the prayers for the Toone family. I will later today post a link to a press release they did last night.

How is bruce doing BTW.
I had to laugh at the radio guy on the commute in this AM. He said, "Hillary has been at Bill's side since yesterday." then a pause, then "and despite that, he's still feeling better!" haha
Just a little joke.
Well, have a good day all!

Boo, thank you for your very kind remark. I will try to continue with more frequent postings.
Hey Rev., since your drummer is on the road, I'd love to audition as a replacement. Unfortunately, I gave my drum set to my nephews hoping they would develop an interest. But after a few years of haphazard practicing (or should I say making noise), they ended up selling the drums (to the delight of their neighbors I suspect).
Boo, MDC, and auh2o, I would never want my washer and dryer "outdoors" in the garage unless I lived in Hawaii where the weather is mostly mild all year round.
When we lived in a condo, we had the washer and dryer indoors on the same level as the living and sleeping areas. I consider that to be the most conveniant and safest arrangement since it is always at room temperature, and there are no stairs to negotiate.
Asa, I would love spring time more if there was less rain and tornados. Also, spring seems to follow the harshest portion of winter, so their are often remnants still visible in some places.
Speaking of washing machines, for those of you with top loaders, do you use the more expensive HE detergents that were designed for these high efficienty machines? We started out using HE detergents until they became hard to find. Since we have switched back to regular detergents, we have not noticed any degradation in cleaning quality. How about you folks?
MDC, I love that radio guy's comment about Hillary being by Bill's side. However, there is more truth than humor in that "joke".
Finally, to compliment what Asa has posted so far, below is a link to a photo of the Toone family. The baby and the girl in the pink dress are the two who died as a result of the pest control poisoning accident.
May they Rest In Peace. And may the Toone family seek comfort during the grieving process.

Good afternoon folks, just a quick trouble check this afternoon. Roofers are working again today, hopefully they will finish soon. They have not been here since Monday, due to the weather, so maybe they can finish up as much as possible before the next snow front moves in.
We have a front loader washing machine and generally use the HE detergent, I usually use liquid gain. The only thing I have noted with the non HE detergents in the seems to be much more
soap suds and it takes longer for the rinse cycle to complete.
I plan to to back to work a few hours next week on Monday, Wednesday and Thursday. I think I will be okay. I am spending all my time sitting at home so I may as well sit in my office chair and talk to people for a few hours. My husband will drive me and bring me back home. Not sure how long i have to wait to drive. It will be 2 weeks this coming Monday since the surgery so I am not sure when it is "okay" to get behind the wheel.
Hope everyone is okay today. wonder if SPOT got his teeth and if

Poor Horatio, I'm with you on the Spring thing. I don't care for all the rain and slush from the melting snow(very hard to ride your bike in. And messy.).
PO, I have never used HE detergents in our machine. Actually never heard of them neither.
I have some very good news. I was sure I had told you all about my co-worker who had a brain aneurysm, but in looking through the archives to see if I did, I didn't see it anywhere. But now you know.
Anyway, this is a young guy(about 25 I think), who was having very bad headaches and wasn't at work for awhile(very unusual for him). So when one of the supervisors called him about two weeks ago, his dad answered and said he was flown to Mayo clinic with the brain aneurysm and wasn't doing well(I think he said they even lost him once). This was a shock to everyone.
So last week sometime, I asked one of the supervisors if anyone had heard how he was doing, and he told me, "Oh yeah, he called the other day."
HE called, I said, very surprised.
The supervisor said yes. Apparently they were just about to do some procedure on him(he had been in a coma, and they were waiting because he was too weak to do anything to), when he started getting better. They said his body was working the aneurysm out on its own. And to my knowledge, they haven't done anything since, and sent him home. He was even in the snack bar at work yesterday with his dad, and he looked great! He has to recoup for the next 6 weeks, but he looks like he is a lot better already.
I had never heard of such a thing happening. I said it was a miracle, which it is. They said his body was working it out "on its own", but I think I know who was really behind it. I think we all do.
Praise God!
Have to go pick up Kai from school.

Yippee, Possum! You got snow. Be sure and make a snow angel with Laci.
So you have been fighting with Jake again, REV? Did he take you? ;-) My niece and nephew (Emily's parents) got a new dog today. He was a "child of divorce" and his owners had to find another home for him. He is a beautiful 2 yr old chocolate lab named "Rocky" and he is the sweetest, most well-tempered dog I have met in a long time. Our black lab Leah has been trying to show him who's boss but soon she will be ga-ga over him. Anyways, today Emily fell from the swing in the yard and the second she fell and started to cry, "Rocky" sprang over to her to make sure she was ok. He's a great dog.

ASA, I'm sorry you're sick - hope you feel better soon, like immediately. That's as far as I've read, but will be back this evening and get caught up. For now, there's a funeral at church - a precious man, a lifelong Gideon, a stalwart pillar of the church, passed away from leukemia. The funeral is today, and my SS class (his wife is a cherished member) is taking food for the meal for the family after the service. We expect about 75 people (big family), so a lot of us are participating. We'll stay and serve, of course.
SNOW! More snow than I've ever seen at one time in my seventy years of living in Texas. It has been a wonderful gift, I've enjoyed every minute, got some (I hope) great pictures, and even tossed Toye Starr out in the middle of it for a couple of minutes. She wasn't impressed.
Now I've got to hit the shower and head for the church with my enormous bowl of green pea and cheese salad. (I love the stuff!) There are eight cans of peas in there, let alone all the other stuff. The bowl is the size of Mt. McKinley, and it's full.
Be blessed - hope everyone is okay ('cept Asa, I know you're sick) and I'll see you all this evening. --Romeena

When we finally got around to taking things out of the boxes, we noticed that one of the bedside tables looked like it had been dropped on one corner and the drawer was broken. It appeared to have happened at the factory and they crated it up and sent it anyway. We are waiting for another one to arrive. Well, now that Bruce is doing well, he decided to put the bed together. We have a really heave king bed and he and Zach took it all apart and then Bruce went to put the new bed, together, which consists of a very heave headboard, footboard and wooden siderails. After trying like crazy to get the side rails in place, we noticed that the slats were the wrong size and they had given us the wrong siderails. I was so aggravated. We paid good money for the furniture, had to wait for it, then wait until Bruce was able to put things together and worked hard, and still it didn't work out. I am ready to call and tell them to come and get it and give me my money back. I think that Bassett furniture company has some real issues. Guess I should have gone with Thomasville or Ethan Allen. I was trying to save money and you know what that will get you sometimes. Anyone else had trouble with the Bassett company?
I had better get to bed so's I can get up fro preachin' in the morning. Goodnight All!

Good evening, all. I spent the evening at Eloise's daughter's home, birthday dinner for Eloise. Just got home, and I'm pooped. I need to get to bed, so I can partake of some of that "fro preachin'" in the morning, like Boo. Thanks, friend, for the "missed ya'" sentiments. It's nice to be missed.
As for the Bassett furniture, I have twin Bassett 3-cushion sofas in my living room, and my big chair and ottoman, and a second ottoman that goes with one of the sofas. I've found them to be sturdy, to wear extremely well, have retained their lines, comfort and appearance. However, obviously there were no assembly issues with those pieces. In your place, I think I would indeed just tell them to come and get it, or at least to send someone with the replacement parts and do the assembly for you. I've never purchased furniture that wasn't delivered, uncrated and set up for me. I didn't even know they did it any other way. Maybe I paid for that service, but if I did, I wasn't aware of it, and it was worth it.
I'm so happy to have the new computer and be up and running, but there really is a lot missing. I have used a program called "Agendus" for years. It's a phone directory, address book, calendar and can be set for alarms to remind of appointments or birthdays, any special event. It contained the phone numbers of practically everyone I know, including all the folks who work around here helping me maintain this house, and all the stores and places I shop, even the Sonic up the street. That's all gone. Folks, I'm here to tell you, if you're not backing up what's on your computer, the WHOLE THING, not just the data, you'd better consider doing it. My favorite games are gone, each of which cost me $20 to download. That's about $120 gone. I'm going to sign up for Carbonite, an offsite backup storage service, and my computer will be backed up to them weekly. It costs $50 a year. It's worth it. It's secure, as many large businesses use it. The upside is, the journal I began right after Dale passed is intact, and is present now on this computer, along with all the other writing I've done. No, there's no "great American novel" there, but it's still stuff I'd rather not lose.
Well, guess I'll head for the ironing board. Little Starr is tired, keeps woofing at me, I think she's ready for bed. Sweet little thing.
Be blessed, friends. It's good to be home. --Romeena

OK, folks - I've already hit a snag. REV, I tried to send you an email and it came back, of course. My "restored" address book doesn't have your new address. Please send it to me, if you don't mind.
Actually, friends, I need everyone to do that, if you don't mind, unless you prefer not to share your address. I feel very disconnected, and will be busy for the next few days trying to reconstruct some of the things I've lost. Some will never be retrieved or rebuilt, but I think I can get most of it. So, if you will, please send it to me at Romeena at tx dot rr dot com. You know the routine.
Also, if someone who still has the Christmas card list would send it back to me, I'd be so grateful. I sent it to you as a document file, as an attachment, so if you have it you should be able to just attach it and send it back to me. If you didn't save the attachment as a separate file, but still have the email, you could try forwarding it back to me. The attachment should go with it. Sorry to be such a pain, but believe me, this crash thing is a bearcat!
Be blessed, friends. --Romeena

"Yo" Possum. Happy Valentine's Day to you too, Cookie. :-)
I don't know where on earth my card list is, Ro, but I will send you my email. Sounds like it has been a royal pain trying to get your computer back on track. Concerning the furniture, I told Bruce to leave it to me. At the time we bought it he insisted he would pick it up himself to save the delivery charge (which was only about 60 dollars!). I told him we are never doing that again. Turns out that he didn't know that when they delivered it they put it together too. I said from now on, we only let them deliver and put things together because of things like this and it is darned well worth the little extra expense. When I had my living room furniture delivered (for 80 dollars), the guys not only got it all there in one piece but even helped me put sliders on the bottom and arranged the furniture the way I wanted it. Anyway, I am calling the furniture place today and telling them to either come and get all of it or come and bring the right parts and put it together themselves, otherwise they can have it and give me my money back. I'm fed up with it.
Well I had better get ready for fro preachin'. See you all later.

Good morning, porch, and happy Valentine's Day to you all. I'll be going to a party at my friend LaRue's house tonight. For the past three years, since her dear husband passed (what a sweetheart he was!), she has hosted a party for the single folks in our SS department. She was planing it again this year, and on Friday morning, due to the show and ice, her power went out. It was still out early Saturday afternoon, so she was very reluctantly canceling the party. I kept telling her it would come back on in time (I was hoping!) and sure enough, yesterday evening it did, so the party is back on. Yippee!
Boo, I couldn't agree more. The little extra expense is well worth it, to avoid hassle, stress and maybe a back injury. Plus, if something is damaged in the process, it's THEIR problem, not yours. I apply that principle in a lot of areas. For example, during our recent showstorm, I took a cab to work. It works for me because I don't live far from the hospital, and it costs $10 each way, tip included. So for $20, my car remained safely in the garage ($250 deductible on my ins#rance if there was an accident) and I was dropped off under the canopy at the back door, so no walking on ice from the parking garage to the main building. I didn't even wear a coat - didn't need one, to walk six steps into the building. Sometimes it pays to look at a situation from a different angle, and be willing to deviate from the usual procedure. To me, $20 vs $250 deductible or possible broken hip was a no-brainer. I know circumstances vary - I might have lived many miles away, or not had the $20, but I live close and for now, I had the $20, so I made the call.
Well, back to exploring possible avenues for rebuilding some of what has been lost. I may have to just install another Agendus program or something similar and start from scratch. Argh. I just hate this. Oh, you should know that if I had your email address before November 2008, and it hasn't changed, I still have it. If it's new since then, I don't have it. Also, for any paranoiacs among you, the old crashed hard drive is back in my possession. I doubt anyone would spend the $1000 or so it would take to extract the information it holds (I won't!), but just in case, I do have the drive right here on my desk. I have the original drives from every computer I've ever replaced, except the very first one, which had no hard drive - hadn't been invented yet! Useless information, huh?
Well, I'm off to rustle up some lunch. As always, I've got leftovers! I think God invented leftovers with me in mind. I love 'em! Be blessed, everyone! --Romeena

Welcome back to Romeena. I read about your computer problems. That was a horrible backing up lesson for you to learn.
I use two 4GB memory sticks to backup all of my data. Since I have all the applications on CD's and DVD's, I only have to back up data files.
You also mentioned that you are planning on subscribing to a data storage site for $50 a year. How much storage does that include?
I'm looking at purchasing an external hard drive for backing up since I'm now downloading a lot more music videos. I have found 1TB external hard drives online for $100. That is 1 Terra Byte, or 1,000 GB of storage!
The secret to extending the life of your external hard drive is to only use it when you are actually backing up. Otherwise, keep it disconnected from the computer and powered off. This way, your backed up data is secure, accessible when offline, and there is less wear and tear on the mechanical parts.

I love the hearts, Possum. I think you should stick with them because you are such a loving Possum. :-)
That taxi idea was really smart, Ro. Great way to handle that situation. By the way, I think "LaRue" is my new favorite name for mature, Texas women. What a great name..."LaRue". I am picturing a woman who still sets her hair in curlers and wears red lipstick and nail polish...a no-nonsense sort who doesn't mince words, very loyal to family, friends and country. Of course she might also smoke and drink beer on the weekends. ;-)
Well, another Sunday is almost over and tomorrow is another busy Monday. Goodnight to all my porch friends. Sweet sleep and pleasant dreams!

Good evening, porch. My apologies - I had forgotten that my daughter had put that "down for repairs" notice on my email, and now I don't know how to remove it! Guess I'll figure it out. Possum, I got the attachment, all intact, and now saved back into my document files. It's the first restorative entry - thank you very much!
Boo, I like the name too. However, your description only partially fits my friend. The hair and the red lipstick fit, and she is very family oriented and loyal to those she loves. Devoted Christian, always the first to show up when there's a need. Had a strongly controlling, overbearing father, and her husband was a take-charge type who handled everything and "protected" her as much as he could, with loving intent. As a result, when he passed, she was basically a lost lamb in a world full of wolves. She's strong though, and is making her way pretty well. She's a worrier by nature, to the point that I've nicknamed her "What if". She takes it well, and in fact is improving a lot, getting a bit tougher and less fearful. She hung in and stuck by me when Dale passed, and I'll always love her for that. She's one of those friends who will stand on the mountain and cheer you on as you pass through a valley, and if you stay there too long, she'll come in and carry you out. Incidentally, her grandkids call her "Mama Rue." Isn't that charming?
Well, I guess I'll hit the ironing board. Tomorrow is another day, unless the Lord returns tonight, and wouldn't that be wonderful?? If He doesn't, then another day is pretty wonderful too. --Romeena

The only place in hawaii that gets snow is atop a high peak, but apparently it didnt have any on Friday. They even did an obsevation from the air to see if there may be a patch under a bush.
But it's still pretty amazing!
